Terms of Service
Last updated:
These are the terms on which VIVA Tuition sells and provides its online courses. They are written to be read, not skimmed: the section on refunds says exactly what we do, in the same numbers the platform enforces.
1. Who we are and how to reach us
VIVA Tuition is a trading name of VIVA Financial Tuition Limited, a company registered in Ireland with company number 596062. Our registered office is at Ground Floor, 71 Lower Baggot Street, Dublin, D02 P593, Ireland.
You can reach us at info@vivatuition.com. That one address handles everything: questions before you buy, support while you study, refund requests, and complaints. We reply within two working days.
In these terms, "we", "us" and "our" mean VIVA Financial Tuition Limited, and "you" means the person buying or using a course.
2. These terms
These terms apply to every purchase you make from us and to your use of the platform at vivatuition.com, including your workspace, the lessons, the mock exams, the AI features, tutor question-and-answer and support. By completing a purchase or using the platform you agree to them.
Two other documents form part of the deal: our privacy policy, which explains how we handle your personal data, and our refund policy, which is summarised in section 7 below.
We sell to individuals studying for professional accountancy qualifications. If you are buying on behalf of an employer or a training provider, the person who will study is the account holder, and these terms apply to them as the user of the platform.
3. Your account
There is no free account. Your account is created when your first purchase succeeds, using the name and email address you gave at checkout, and we email you a link to set your password. You can also sign in with a Google account that uses the same email address.
An account is for one person. Keep your password to yourself, do not let anyone else use your account, and tell us straight away at info@vivatuition.com if you think someone else has used it. Everything done through your account is treated as done by you unless you have told us otherwise.
The details on your account must be accurate and kept up to date. We use your email address for everything that matters - receipts, password resets, marking results - so if it stops working you will miss things.
4. Buying a course
Courses are sold per subject, as a pack covering a level of the qualification, or as several levels together at a bundle discount. What a course includes is described on its page and on the pricing page at the time you buy.
Payment is taken at checkout by our payment provider, Stripe. We do not see or store your card details. The contract between us is formed when your payment succeeds; we then email you a confirmation, open the course in your workspace and, if you are new, create your account. If a payment fails or is later reversed by your card issuer, the course is not, or is no longer, yours.
Very occasionally a course may be shown at an obviously wrong price. If that happens we will tell you before the course opens and offer you the choice of paying the correct price or a full refund.
5. Lifetime access and what you get
Every course comes with lifetime access. There is no subscription, no renewal and no expiry date: you pay once and keep access to the course for as long as we operate the platform. When CIMA or ACCA change a syllabus we update the course, and you keep access to the updated version. If we ever had to withdraw a course you had bought, we would tell you in advance and treat you fairly, including a refund where that is the right outcome.
Every course includes the video lessons for the subject, the AI Tutor and our support inbox. CIMA Objective Test courses also include full timed mock exams, marked on the platform. CIMA Case Study courses (the Operational, Management and Strategic Case Studies) also include online mock exams and shorter Core Activity Mini-mocks, marked with feedback, and the ability to ask a tutor questions about the lessons. ACCA courses include the video lessons, the AI Tutor and our support inbox.
Access is personal to you and for your own study. It cannot be transferred, shared or resold.
6. Prices, credit and discount codes
Prices are shown in pounds sterling and include VAT where it applies. The price shown at checkout is the price you pay. We can change prices at any time, but a change never affects a purchase you have already made.
When you add to what you own, you never pay twice for the same course. Anything you have already bought from us comes off the price of a pack that contains it, up to the price of that pack. Bundle discounts for taking more than one level come off what you are buying at the time. Credit and discounts are applied automatically at checkout and shown before you pay. An amount that has been refunded to you no longer counts as credit.
A discount code applies to the purchase it is entered on, subject to any conditions shown with the code. Codes cannot be exchanged for cash and cannot be applied after a purchase has been made.
7. Changing your mind and refunds
Your statutory right to cancel
Our courses are digital content supplied online. Under Irish and EU consumer law, including the Consumer Rights Act 2022, you have 14 days from the day of purchase to cancel. Because the course opens the moment you pay, by completing your purchase you ask us to make it available to you immediately, and you acknowledge that once you have started using it you lose the statutory right to cancel. We treat completing 20% or more of the lessons in a course, or submitting a full mock exam, as having started to use it.
Our refund policy
Our own policy is at least as generous as the law requires. You can have a full refund if you ask within 14 days of buying, you have completed less than 20% of the lessons in the course, and you have not submitted a full mock exam. You do not need to give a reason. Email info@vivatuition.com from the address on your account and tell us which course; we check your progress against these limits and reply within two working days.
Everything bought in a single checkout counts as one purchase, including several levels bought together. A pack is one purchase: we refund the pack as a whole, judged on your progress across it, rather than individual subjects out of a pack. Once a full refund is processed, access to everything in that purchase is removed, and the amount refunded no longer counts as credit towards a later pack. Refunds go to your original payment method and usually clear within 5 to 10 working days.
The full policy is on the refunds page. Nothing in this section affects your statutory rights, including your rights under the Consumer Rights Act 2022 if a course is faulty or not as described.
8. AI features
Some feedback on the platform is produced by artificial intelligence: the marking of written mock exams on CIMA Case Study courses, and the AI Tutor.
Our AI marking works from marking grids we write for each exam. The grids are influenced by CIMA's published guidance, including its post-exam reports and examiner guidance, together with our tutors' experience of what earns marks in the real exam. We review a sample of marked mocks to check how the marking is performing, and use what we find to keep refining it.
Marks and feedback are released to you as soon as the AI produces them, without a tutor reviewing them first. AI feedback can be wrong. It is study feedback, not an official mark, and not professional advice. Only the professional body's own result counts as your exam result.
We are an independent tuition provider and a CIMA Registered Tuition Provider. We are not CIMA or ACCA, and we do not speak for either body.
9. Acceptable use
You agree not to:
- share your account, or let anyone else study on it;
- copy, download, record, redistribute or resell course content, in whole or in part, other than for your own study on the platform;
- scrape the platform, run automated tools against it, or attempt to get around access controls;
- upload to the platform anything unlawful, offensive or that infringes someone else's rights, including in tutor questions, written exam answers and support messages;
- use the platform to cheat in an official exam, or to help anyone else to.
If you break these terms we may suspend or close your account. We will tell you why, and we will not refund a course on an account closed for a serious breach.
10. Content and intellectual property
Everything on the platform - the videos, notes, questions, mock exams, marking and the software behind them - belongs to us or to the people who license it to us, and is protected by copyright and other intellectual property laws. Buying a course gives you a personal, non-transferable licence to use that content for your own study, for as long as you have access. It does not transfer any rights to you.
CIMA and ACCA, their qualification names and their syllabus and exam materials belong to those bodies. We use them for the purpose of teaching towards their exams.
Anything you write on the platform - a question to a tutor, a written exam answer, a support message - stays yours. You give us permission to use it to provide the service to you, including sending a written answer to be marked.
11. Availability and changes to the platform
We work to keep the platform available at all times, but it is delivered over the internet and there will be occasional interruptions for maintenance or for reasons outside our control. We are not responsible for an interruption to your internet connection or your device.
We improve the platform continuously and may change, add or remove features. We will not remove anything that would leave a course you have bought materially less than it was described as when you bought it.
12. Our responsibility to you
If we fail to comply with these terms we are responsible for loss or damage you suffer that is a foreseeable result of our breaking them or of our failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude or limit.
Passing an exam depends on you as well as on us. We do not promise any exam result and are not responsible for the consequences of an exam outcome, such as exam fees, resit costs or lost earnings. Subject to the paragraphs above, our total liability to you in connection with a course is limited to the amount you paid for it.
13. Complaints
If something has gone wrong, email info@vivatuition.com and tell us what happened. We will acknowledge your complaint within two working days and aim to resolve it within ten. If you are not satisfied with our response, your legal rights are unaffected and you can take the matter to court as described in section 14.
14. Governing law
These terms are governed by the law of Ireland, and you can bring a claim in the courts of Ireland. If you live in another country, you keep the protection of the mandatory consumer laws of the country where you live, and you may also be able to bring a claim in the courts there.
15. Changes to these terms
We update these terms when the product or the law changes. The date at the top shows when they were last changed. A change applies to purchases made after it; the terms that applied when you bought continue to apply to that purchase. If a change would materially affect the way you use a course you already own, we will email you before it takes effect.
